1. Service Description

StillHere ("the Service") is a dead man's switch platform that delivers pre-configured messages to designated beneficiaries when a user fails to check in within their configured interval. The Service operates through multiple delivery channels including email, WhatsApp, Telegram, SMS, and Discord.

2. Obligation of Execution

The Service commits contractually to execute user instructions when the switch is activated. Delivery attempts are logged with timestamps, channels, statuses, and read receipts to form a Proof of Delivery audit trail. These logs constitute evidence of fulfillment.

3. Escalation Process

Before activation, the Service follows a graduated escalation: reminder notification (5 days before deadline), warning notification (2 days before), grace period (24 hours final window). Only after all escalation steps are exhausted does the switch trigger and messages begin delivery.

4. Zero-Knowledge Architecture

Messages marked as client-side encrypted are encrypted in the user's browser using AES-256-GCM before transmission to our servers. We store only encrypted blobs that are mathematically impossible to read without the beneficiary's passphrase. We cannot recover encrypted messages if the passphrase is lost.

5. Limitation of Liability

The Service is not responsible for the content of messages nor the actions of beneficiaries after receipt. The Service is not a substitute for a legal will or testament. The Service does not provide legal or financial advice.

6. Data Retention

Messages and delivery logs are retained for 12 months after switch activation for legal dispute purposes. Users may request data deletion at any time for non-triggered accounts.

7. Beneficiary Verification

The Service does not verify the identity of beneficiaries beyond the contact information provided by the user. Pre-notification informs beneficiaries of their designation but does not require their consent.

8. Service Continuity

The Service operates a backup delivery mechanism to ensure pending deliveries are executed even in the event of primary service failure. We are committed to not repeating the fate of discontinued competitors.

9. Subscription & Cancellation

Paid subscriptions are billed monthly via Stripe. Cancellation takes effect at the end of the billing period. Upon cancellation, the account reverts to Free tier limitations. Pending triggered deliveries will still be executed.

10. Prohibited Use

The Service may not be used for threats, extortion, harassment, or any illegal purpose. We reserve the right to cooperate with law enforcement when required and to terminate accounts that violate these terms.
